Separate but equal was invented by the people, then ratified by the Justices.

Try again.

And abortion was allowed everywhere until 1821: "Connecticut was the first U.S. state to outlaw medicinal abortion after quickening in 1821, followed by 10 of the 26 states creating similar restrictions within 20 years. New York made post-quickening abortions a felony and pre-quickening abortions a misdemeanor in 1829."
Until you actually read the Dobbs decision(why are you afraid to?)
 you are only regurgitating ignorance.

Alito carefully laid out a case that unwritten rights, to be enforced by courts, must be deeply rooted in our history.
To wit   (a) From the 1200s to 1960, no statute, no English case, no state case, no federal case, no legal treatise, and no law review article hinted at an abortion right. the right to marriage equality or the right to homosexual conduct On the contrary, abortion homosexual conduct at any stage was (b) unlawful at common law and (c) widely criminalized by the time of the 14th Amendment And gay marriage was forbidden everywhere

Either read understand the decision or move on.
Every single time you post you undercut your view that Dobbs does not threaten gay marriage and other cherished accepted rights. But then you already admitted that you engage in "the fiction that the expected and intended consequence of the abortion decision is irrelevant." So your pretending not to recognize that Dobbs emperils other rights is just your normal operating procedure. You Comically Transparent Partisan Hack.
Since you (a) refuse to read the Dobbs Decision(b) blatantly misrepresent my words, and (c) ignore the world you live in I feel no compunction to respond.
Retreat IS your best option.
RETREAT? LOL.
You are whistling as your party is slowly filling up the graveyard of ignorance and bad policies.
In the meantime we now have a court that has deep sixed talk of a LIVING Constitution, returning us to the concept of power to the people who control how we govern ourselves, including creating unenumerated rights.

And the best example of that is same sex marriage. Barack Obama was  elected President while defending marriage as ONLY  a union of a man and a woman.  Two years later he and millions of others had other thoughts.

I have been unwilling to sign on to same-sex marriage, but times are changing and attitudes evolve, including mine. And I think that it is an issue that I wrestle with and think about because I have a whole host of friends who are in gay partnerships. I have staff members who are in committed, monogamous relationships, who are raising children, who are wonderful parents.

Five years later same sex marriage was recognized federally and in all 50 States.
Except for those with religious objections the people have endorsed and accepted this new right which is now fully ingrained in our culture.

As the Dobbs majority points out nothing in its decision has any bearing on same sex marriage.

The DOD is supporting the Justice Department, which is the lead federal agency in this situation. They relied on estimates of the Metropolitan Police and Capitol Hill Police. Those organizations, which had experience with pro Trump groups in November and December, believed the request they made for personnel was adequate.

We dont do domestic  intelligence collection, Hoffman said.  We rely on Capitol Police and federal law enforcement to provide an assessment of the situation. And based on that assessment that they had, they believed they had sufficient personnel and did not make a request.

Quote
No one really buys the argument that what was (egregiously wrong) with Roe v. Wade, to quote the Dobbs majority, was the courts failure to check the right analytic boxes. It was not constitutional analysis but religious doctrine that drove the opposition to Roe. And it was the courts unacknowledged embrace of religious doctrine that has turned American women into desperate refugees fleeing their home states in pursuit of reproductive health care that less than a month ago was theirs by right.
To be sure, the Supreme Court has not outlawed abortion. Justice Samuel Alito left that dirty work to the states - Who will rid me of this bothersome right to abortion? But during the nearly two months between the leak of his Dobbs draft on May 2 and the release of the official opinion on June 24, it became painfully obvious to all that if Roe fell, abortion would soon be illegal or all but inaccessible in about half the states. That was the point, after all.
Not only did that prospect make no difference to the Dobbs majority - the official opinion was essentially unchanged from the leaked draft except for added sections that responded to, and distorted, the dissenting opinions - but Justice Alito actually had the gall to write that (we do not pretend to know how our political system or society will respond to todays decision.) Polls conducted before the opinion s release showing that upward of two-thirds of Americans wanted to retain a right to abortion offered a hint and were perhaps what led to Justice Alitos self-righteous declaration  (We cannot allow our decisions to be affected by any extraneous influences such as concern about the publics reaction to our work.)
Justice Alito took pains to present the majoritys conclusion as the product of pure legal reasoning engaged in by judges standing majestically above the fray of Americans (sharply conflicting views) on the (profound moral issue) of abortion, as he put it in the opinions first paragraph. And yet that very framing, the assumption that the moral gravity of abortion is singular and self-evident, gives away more than members of the majority, all five of whom were raised in the Catholic church, may have intended...

Your refusal to acknowledge that the reasoning in Dobbs applies in full to gay marriage and gay sex is undercut by the actual text you post from Dobbs.  Every time,, as a simple word substitution proves.

And Obama having a change of heart is utterly inapplicable to the type of reactionary social warriors now in charge of Republican activists, many state governments and the Supreme Court.

Q:  "Where did the President contract COVID?"

WH Spokes - "I don't think that matters  ..."

Well, alright then.

(As pointed out on Outnumbered, Ms JeanPierre gets so angry when asked these simple questions.)

The Obama quote was representative of American opinion in 2010.
It has grown immensely since with no group opposing the policy.
