Gov. Greg Abbott signs bill making illegal immigration a state crime

Why isnt he running for prez?

https://www.texastribune.org/2023/12/18/texas-governor-abbott-bills-border-wall-illegal-entry-crime-sb3-sb4/
He cannot run because Trump has a headlock on the performative hatred voting bloc. Among other reasons.

And the ability to politically grandstand by passing laws he fully knows are unconstitutional does make him an attractive candidate in today's Authoritarian version of the Repo party, as well as with haters and bigots like you.
Abbott has passed no unconstitutional law in Texas.

Prosecution is not only for insurrectionists in the executive branch.

Amazing what can be learned if one reads all the way to the last paragraph.  Scotus ruled against such a law in AZ in 2012.

See other thread.  Depends on SCotUS ruling on Colorado and what other states might also decide on removal of Trump from ballot.  Colorado alone does nothing since it wouldn't go for Trump anyway in the general.  Or give Nikki a significant number of delegates at the convention.

I would be surprised if the Colorado decision stands. The Court temds to try to find a way to keep the courts out of that kind of dispute.

Makes sense.  I would guess a clause set up for Civil War renegades is seen as a bit of a reach.  Especially for the Yam of many loopholes.

But what a three ring goat rodeo that would be, if Supremes let it stand.

Is the Supreme Court going to intrude into how states conduct their elections? States rights guys like Red will be up in arms.

If it does intrude, will the so called originalists go against the clear language of the 14th amendment?

Justices who vote overrule Colorado in this should be expelled from the court and tossed in the Potomac instead.

In 1874 Democrats flipped the House for the first time in 16 years by electing 51 former Confederate soldiers or government officials. This included the Confederacy Vice President.

Section 3 of the Fourteenth Amendment was originally intended to keep former Confederate officials from gaining power in the reconstructed government following the Civil War.  That its force had already eroded by 1874 sort of underscores my allusion to political factions tend to find workarounds.  That said, Gorsuch 2012 decision is going to be awkward for him - see the News in General post I just put up.

Actually the Colorado decision is so nonsenical SCOTUS will likely throw it back to the lower court and ask them to explain what defines insurrection.

The court could do the right thing and concur with Colorado in the correct action taken by its Supreme Court.
