Good luck with that in any Court. Congress cannot remove a disability that does not exist.

Good luck with that in any Court. Congress cannot remove a disability that does not exist.
There is nothing to take to court.

In fact, Section 3 of the 14th Amendment is self-executing, which means that congressional action is not required. Nor is it required that the former president be convicted of the criminal offense of an insurrection or rebellion against the United States under Title 18 USC 2383.

Well except for the fact that section 3 was repealed 150 years ago and there is no difinitive finding that Jan 6 was an insurrection.

In the spirit of the act, then United States President Ulysses S. Grant, by proclamation dated June 1, 1872, directed all district attorneys having charge of proceedings and prosecutions against those who had been disqualified by the Fourteenth Amendment to dismiss and discontinue them, except as to persons who fall within the exceptions named in the act.[5] President Grant also pardoned all but 500 former top Confederate leaders.

Good luck trying to bar Trump using
repealed civil war legislation. No woner the constitutional scholar avoided that issue.

And the state.of Colorado just made a definitive finding that January 6 was an insurrection.

I am not sure what is more outlandishly stupid: your calling a Constitutional Amendment "legislation", or your belief Congress can repeal a Constitutional Amendment, or the idea that an act that "removed office holding disqualifications against most of the secessionists who rebelled in the American Civil War" somehow applies to someone whose Grandparent had not even been born when the Civil War ended.

The 14th amendment is still in force.
Section three was modified as to the penalties for insurrection and done so by the framework set up by the legislature drafting the 14th amendment ( 2/3rd majorities in-house and Senate.)

The lower court in Colorado ( through a bench trial) found Trump May have committed an insurrection but did not remove him from the ballot citing the office of the presidency was not included inSection3.


The Colorado SupremeCourt overturned the lower Court 4-3.

Now we await SCOTUS.

Chances are strong it will simply punt it  back to the lower court for clarification on insurrection and the role of the President.
