Funny that Kid didn't mention the psychiatric evaluation that had been ordered months before the Buffalo shooter was able to purchase a new rifle.  He had made threats against his high school.  And was able to buy a gun.

The problem with not digging for facts is it results in shallow analysis. 

One reason federal law matters in gun control is that bad actors often own cars.  So a patchwork of different laws in different states allows them to obtain mass killing equipment.

Really.

He did not threaten anybody specific and explained away his language as just saying stupid shit. He was believed and they released him.

What is it that you think they should do about it?

A federal district court Monday temporarily blocked the enforcement of two Biden administration mandates forcing both nonprofit and for-profit religious employers and health care providers to pay for and perform transgender medical procedures and counseling even if these measures violate the employers' or providers' religious beliefs.

Another Biden defeat by the courts in his ongoing intent to ignore the First Amendment.
The Judge granted the injunction saying the plaintiffs  were likely to win the case in its merits.

No government agency ought to be in the business of evaluating the sincerity of another s religious beliefs.
HEalth and Human Services Guidance encourages a parent to file a complaint if a medical provider refuses to gender transition their child,   of any age, including an infant. The thought that a newborn child could be surgically altered to change gender is the result of the Biden HHS Notification and HHS Guidance that brands a refusal by a medical professional to do so as discrimination. Indeed, the HHS Guidance specifically invites the public to file complaints for acting in a manner the Plantive says is consistent with their sincerely held religious beliefs.

Medical facilities, like bakeries, serve the public.  When you work for either one, you park your car, and your religious beliefs, outside, and do the job you have agreed to do when you entered into an employment contract.  Don't want to bake wedding cakes for LGBT couples?  Then don't work in a bakery.   Don't want to perform sexual transition procedures?  Then don't work in that aspect of medicine.  (I hear respiratory therapists are in demand atm...).

When you go to Burger King, does the counter person who is Hindu or Buddhist or 7th Day Adventist refuse to make you a Whopper because of their religion?

What good is any state's law if it doesn't mesh with nearby states?  Conklin, NY to Great Bend, PA = 8 miles.  If NY LEGISLATURE did pass a watch list law (no gun sales to anyone who had a psychiatric evaluation for potential violent threat, in the past couple years, say), what good is it in Conklin if the gun store in Great Bend operates under looser law?

You missed it.  Talking about the need for a federal law on this matter.  Should I expect to post the 10th amendment now?  Or cite Printz v US?  Skip it.

This goes back to the Supremacy clause, Article VI.  Gunsellers would have to comply with a federally mandated requirement to check background, including psychiatric eval for violent threats, if such legislation were passed.  State laws that contradicted would be voided by the Supremacy Clause.  Angry racist in Conklin NY could no longer drive eight miles to a gun store in PA and get his killing kit.

The argument that Ward is making is that any such law would fail because there is no grounding for it in the Constitution. I think the only way around that could possibly be invocation of the severely overtaxed (not fiscally) Interstate Commerce component, but even that feels like a stretch to me.

This explains, in part, why Kid's attack on the NYC AG, etc., is so lame.

What is needed is a hard to get amendment to the Constitution or a modification of laws in neighboring states which excludes out of state individuals from buying things in state that would otherwise be forbidden to them.

Conversely, the Feds could try passing a law to influence states in the same way they manipulated highway money to be dependent on adherence to the preferred highway speed limit, because they could not enforce a federal speed limit.
