Not in civilian court
Unpremeditated murder is what he was guilty of in the court martial
Prosecution withheld evidence. What is wrong with these people?

In the end, Commander in Chief of the US Armed Forces did the right thing.
As you were now....
For the record Behenna disobeyed orders to drive a released suspect home, drove him instead into the desert, stripped him naked, questioned him at gun point, and then shot the naked released suspect in the head and the chest, claiming he thought the guy was making a move for his gun. Fuck him. While I understand combat related deaths, what Behenna did is nothing short of a war crime. In a civilian court, kid, you would not be allowed a claim of self defense for killing someone you had kidnapped. Any killing in the commission of a felony is first degree murder.
