He was convicted of murder.



Actually he was found not guilty of the charges levied.  In a real (civilian) court of law he may very well have been set free.  But - as this was a court martial - Behenna was able to be sentenced on a lesser charge.  Served just 5 years of the initial 25 year sentence after info that had been withheld surfaced.

Should be pointed out this was yet another soldier who did not get proper psych treatment when needed.  No easy answer, I know
People get convicted of lesser included offenses in civilian courts all the time. It is still a conviction.

For the record Behenna disobeyed orders to drive a released suspect home, drove him instead into the desert, stripped him naked, questioned him at gun point, and then shot the naked released suspect in the head and the chest, claiming he thought the guy was making a move for his gun. Fuck him. While I understand combat related deaths, what Behenna did is nothing short of a war crime. In a civilian court, kid, you would not be allowed a claim of self defense for killing someone you had kidnapped. Any killing in the commission of a felony is first degree murder.
