How about it being just wrong, no matter the offender's background? Isn't that enough?

If Anita Hill looked Christine Blasey Ford, Clarence Thomas would not be the Senior Associate Justice.
Thomas was not accused of a crime.

Sexual harassment in the workplace is okay for a SCOTUS?  How about that moral elasticity, ?

As we just learned Mrs. Ford won’t testify next week until an FBI investigation is completed.
Her intentions are now clear. Delay Kavanaugh a seat on SCOTUS until after the mid-terms.

In this instance, even if they have the vote after the mid-term elections and even if the Dems claim sufficient members of the Senate that they would be able to block the nomination after inauguration day, there is nothing that would preclude the GOP's ramming it through duing their lame duck session.

The sole strategy of the democrats in this 11th hour of the confirmation process is to delay the final vote past the mid-terms.
Actually, the strategy is to defeat Kavanaugh, a liar and possible attempted rapist. The Dems are well aware That if they take the Senate - not likely but possible- the Repos.would jam through Kavanagh in the lame duck session.

How would you judge what is attempted sexual assault and what is attempted rape?

My satiric web show reference was to people missing the larger point:  sexual assault is a crime against a person, it doesn't require penetration to be a crime.  The alleged actions of Kavanaugh are clearly of a sexual nature.   Dragging someone into a room, closing the door, holding them down on a bed, forcibly covering their mouth, and then attempting to remove clothing (accompanied by grinding motions against the person) while that someone clearly indicates this is unwanted and assaultive, is a SEXUAL assault.  It's not about a birthday spank.  The question of whether this behavior was headed towards penetrative rape is probably beyond the ability of any forensic system to determine absolutely, but it doesn't alter the fact that it conforms to the definition of sexual assault of a felonious nature.  It is clearly (if accurately described) NOT "horseplay." 

So, IMO, nattering on about when it fits some technical definition of "rape" is largely a red herring.

In MD, there is no "attempted rape" option, legally. There are rape and sexual assault laws, with 2 classes of rape and 4 of sexual assault. It sounds as if the 3rd class of sexual assault is what is described by the accuser, because Kavanaugh had help, according to her.
