Do you highlight your little Federalist Society pocket Constitution in green or yellow, Red?I'll ask you again. Is it your argument that a no vote by the Senate would have constituted a denial of due process? Let's see if you can answer a simple yes or no question.
Of course it would.
Under the standard of due process there is no crime that can be corroborated.
But as you certainly noticed the democrats moved away from the “ crime” to talk about his love of beer and then his “ unseemly” temperament in defending himself.
But they drew the ill- advised last second Hail Mary play by throwing due process in the gutter and no matter how they explain it now they have greatly diminished their mid term election outlook.
You have no clue what due process is.
It is you who is confused.
Due process in this instance is the process of the Senate to provide its Constitutional duty to Advise and Consent on SCOTUS nominations. That process allows the Judiciary Committee to investigate nominees and then report its recommendations to the full Senate. In the course of that investigation the ranking democrat on the committee, Diane Feinstein, received a letter from Dr. Ford alleging a sexual assault of her by the nominee when both were teenagers. Dr. Ford asked that her information be kept secret. Senator Feinstein did nothing until the Committee was getting close to voting. ( She could have notified the Committee who could have conducted a secret investigation) As the process was winding down she sent the letter to the FBI and leaked its contents to the Washington Post.
She got the intended result: short circuiting the Senate process. Once the full committee learned of the letter it asked Dr. Ford and Justice Kavanaugh to come back for more testimony.
Which they did which led to a she said/he said appearance that in essence changed no votes . So the committee sent the nomination to the full Senate.
Howls by the democrats now centered on Kavanaugh’s teen age drinking and his temperament in defending himself. So at the suggestion of the GOP another delay was authorized and a request made to the FBI to investigate. Which turned up nothing to corroborate the original charge by Dr. Ford.
So here we are today waiting for the Senate to vote.
But it is clear that the democrats sole strategy is to disrupt due process to either defeat Kavanaugh or delay his appointment.
You have no clue what due process means. It becomes clearer with every post.
You also seem to have forgotten Garland. If nominees were entitled to fundamental fairness in the nomination process he would be on the Court today.
