China: fewer than 5,000 CV deaths
ON THEIR SOIL
100 times as many caused elsewhere

1. Do you think if a novel coronavirus zoonotically initiated in the US that the Trump Admin would have taken quick action and stomped it out?
(there are both bats and potential virus lab accidents in the US)

2. The main strain of the CV virus in the US came from Italy, shouldn't they shoulder blame following your logic?

3. Wouldn't it have been best for the US to follow the China approach and undergo a 2 month lockdown, followed by a careful two month gradual reopening, and then carefully monitoring the virus free country thereafter?

I think it's pretty clear that the Trump response has been sub-optimal with many more Americans getting infected and ill and dying than was necessary.

Given that he gives Trump a B+ in his handling of the virus, I am sure that he believes Trump would have done the best possible job.

In the last 40 years, this will be only the 3rd new justice ideologically opposite to the justice they replace:

-Clarence Thomas replaced Thurgood Marshall in what has become apparently the black seat.
- While RBG herself succeeded Byron Whizzer White, who was a Kennedy appointment and the only modern example of ideological drift to the Right, as Justice White became a pretty reliable conservative vote, opposed to due process expansion, any limits on policing (including Miranda warnings), was one of two votes along with Rehnquist against Roe v. Wade, and always was pro-business.

Otherwise, center-left Souter was replaced by far-left Sotomeyer and center-right Sandra Day O'C by far-right Scalito (Sam Alito). It's too early to know about Kavanaugh replacing center-right Kennedy.

RBG was the last appointee who was 60 when seated. 3 of the last 5 justices were 50 years old when they started their lifetime term. Roberts, Kagan, Gorsuch.
The oldest this century has been 56, with the definite trend to nominate someone 50-55.

Any explanation for why the US has the highest number of both infections and CV deaths.  How did that happen?

With the death toll continuing to climb, Trump has also repeatedly passed up opportunities to serve as a unifying force for communities and families grieving the loss of loved ones. Instead, he’s effectively discounted the deaths of Americans who live in Democratic-leaning states, suggesting he has little responsibility for the well-being of those who don’t support him politically.

“If you take the blue states out, we’re at a level that I don’t think anybody in the world would be at,” Trump said this past week about the death toll. “Some of the states, they were blue states and blue state-managed.”

It was a jarring statement from an American president, yet one in keeping with Trump’s handling of the pandemic and his presidency. He’s long taken a transactional approach to his office, and he spent the opening weeks of the pandemic feuding with Democratic governors in hard-hit states, challenging them to lift restrictions that he deemed harmful to the strong economy he’d hoped to ride to a second term.

So Trump blames Blue State Dem Govs for handling the virus badly, even as Trump offered no national plan and tried to force them to open their state economies early making things worse, increasing transmission/infection/deaths.

It's all their fault ... as long as you don't notice the negligence and harm Trump caused them.

"Nobody could have done better."

"If you subtract the blue states..."

"It is what it is."

No, he has no explanations, just excuses and distractions and lies. Why would you expect anything different?

Oh, also evasions and ignoring the question are in his command.

And as he ignores the increasing tide of cases across the majority of states - and the intentional undercounting of both cases and deaths.

One way for Democrats to make clear they will not tolerate Republicans trying to fill this seat in advance of the election would be for them to pledge that, if they take the White House and Senate in November, they will increase the size of the Supreme Court to 13 justices.
From LAT.

Yep.

But for now one must consider that if we have another Bush v Gore, which we had no business ever having in the first place, Trump SCOTUS appointee could be involved. Also, if there is no appointee, a SCOTUS 4-4 decision could be rendered.

Then, it's "say hello to my little friend Civil War"!

The part I find confusing is that SCOTUS ties have meant that a case reverts to the lower court decision.  But where does it go when there  is no lower court involved?

Clause 2 of Article III of the Constitution explains:

Original and Appellate Jurisdiction
In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be a Party, the Supreme Court shall have original Jurisdiction. In all other Cases before mentioned, the Supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.
