Red seems to have a difficult time grasping the idea that the Constitution can be interpreted differently by those with different perspectives, as new circumstances are called on to be adjudicated.

While the recent 5-4 vote upheld the right of religious congregations to assemble with no restrictions as to the # of congregants, despite the heightened risks of spreading disease they may pose to society, that vote likely would have been 5-4 the other way if held 6 months ago without Justice Serena Joy on the court.

Article One would still have been a nice starting point but I'm not sure Red would cite it to affirm that hypothetical SC decision.

Red also fails to consider that restrictions applied even MORE vigorously to businesses in NY,  so it's really hard to argue churches or temples were singled out on a basis prejudicial towards religion.   And other case precedents  have affirmed that restrictions applied generally across society are not a discriminatory abridgement of religious worship.

Yup.

I get that restricions on attendence at religious observations is tricky stuff as it goes to the heart of why this country was founded.

But if the Consitution starts with,

We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare

If we can accept that our founding fathers put primacy on "insuring domestic tranquility" and "promoting the general welfare" is it a leap to think they could accept limitations on religious gatherings to help stop a fucking plague from killing us?

Constitutional religious freedom has never meant "freedom from all secular law."  If gatherings are generally banned, then no group is excepted from that ban.  If murder is illegal, you can't gather at the Church of Quetzlcoatl and slaughter three virgins to appease angry volcanoes and claim you have religious freedom to do so.
What “ secular” law are you referring to in this case?

Kiid is relying on his belief that most republicans do not have the mental capacity to follow or participate in a game of basketball.

He believes they prefer sports that involve nothing more complicated than turning left or spoiling a perfectly good walk (with carts, naturally).

I don’t think there have been scientific studies done on this, but if there were this belief would likely be confirmed.

All true.   Lots of yokels and assorted rednecks love to burn one.   As pot smoking spreads through conservative states,  I can see a possible shift to less hawkish policies,  as it becomes harder and harder to muster an army.   "Enlist?   What are y'all talkin about -- I'm listening to my Tame Impala track and there's scones baking in the oven, man.   And my clock says 420!"  It's  always 420 somewhere,  if you use local solar time.

Trump always expected it to go to SCOTUS

Trump perhaps hopes a Supreme Court he helped steer toward a conservative 6-3 majority would be more open to his pleas, especially since the high court upheld Pennsylvania’s decision to accept mail-in ballots through Nov. 6 by only a 4-4 vote last month. Since then, Trump nominee Amy Coney Barrett has joined the court.

Trump lost the popular vote by 6 million votes

He lost the EC by a substantisl margin

He has lost in court challenge after court challenge to contest the election as rigged

He has been repudiated by the voters and the courts and Republican state officials and Republican (Trump) appointed judges doing their jobs as they saw fit.

What side of the ass-kicking scoreboard in the context of my post would you like me consider?

SC justices picked 3

SC justices he should have picked 2

SC justice he would have picked without Russian interference and help 0


He may have one more shot at destroying the SC with an appeal.

If they were wise they would pass on his merit-less fantasies and delusions

and refer him to a psychiatric practice to get the remedy he really needs
