It included two other cases, one of which had not previously been consolidated into the case, but heard separately:
Altitude Express Inc. v. Zarda, R.G. & G.R. Harris Funeral Homes Inc. v. Equal Employment Opportunity Commission.
The latter two had been decided one way, while the 11th Circuit had decided the other way, for the defendant.
